Macrofy Terms of Service (EULA)

1. Acceptance of Terms

Welcome to Macrofy, a mobile application provided by MB "Appmonster Technologies", a Small Partnership duly registered under the laws of the Republic of Lithuania, company code 306141982, having its registered address at Vilnius, Treniotos g. 2-12, LT-08121, Lithuania.

By downloading, accessing, or using the Macrofy mobile application (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("User") and MB "Appmonster Technologies" ("Company", "we", "us", or "our").

2. Eligibility

You must be at least 16 years old to create an account and use the Service independently. We do not knowingly allow individuals under the age of 16 to create an account or provide personal data without parental or legal guardian consent.

Children under 16 may only use the Service under the supervision of a parent or legal guardian, and only through features that allow a parent-managed or paired experience (e.g., Parent + Child Paired Mode). The parent or legal guardian remains fully responsible for the child's use of the Service and for all data provided on behalf of the child.

If we learn that a minor under 16 has created an account without proper authorization, we may suspend or delete the account in accordance with our policies.

The Service is intended for wellness and general lifestyle support and is not directed to unsupervised minors or individuals with conditions requiring professional medical guidance.

3. Description of the Service

Macrofy is a health and wellness application that provides users with tools and information to support their nutrition and fitness goals. Key features of the Service include:

Nutrition and Diet Recommendations

Personalized meal plans, macronutrient suggestions, and dietary guidance to help you eat healthily (for example, guidance on daily calorie intake, protein/carbs/fat targets, etc.). These recommendations may adapt over time based on your progress and data.

Activity, Sleep and Wellness Analysis

Macrofy can integrate with a range of fitness and health platforms — including Apple HealthKit, Google Fit, Fitbit, Garmin Connect, Oura, Samsung Health, WHOOP, and other compatible wellness apps — to analyze your daily activity, steps, workouts, heart rate, heart rate variability (HRV), sleep duration and quality, stress indicators, and overall wellness metrics.

If you grant permission, Macrofy may read data such as:

  • steps and movement data
  • distance, workouts, active minutes
  • heart rate and HRV
  • resting energy and active calories
  • sleep stages, sleep duration, and sleep quality
  • stress level metrics (if supported by your device)
  • mindfulness minutes or recovery metrics
  • weight and body measurements
  • other health-related data made available through integrated platforms

This information helps Macrofy dynamically adjust your daily calorie targets, activity goals, recovery recommendations, and personalized nutrition suggestions, allowing the Service to provide a more holistic and adaptive wellness experience.

AI Coaching

Macrofy may use third-party artificial intelligence services to generate automated coaching messages and personalized insights. These services process your inputs to produce recommendations based on recognized data patterns. All AI-generated guidance is non-medical and may contain inaccuracies. (See AI Disclaimer.)

Adaptive Calorie Counting

Macrofy can automatically adjust your daily calorie allowance or goals after assessing your status and data (for example, adjusting for exercise burned calories or changes in your weight or activity, using data obtained from Apple HealthKit/Google Fit). This helps create a more responsive and personalized plan for you.

Paired Mode (Dual-User Feature)

An optional "paired mode" that allows two users (for example, partners or friends) to connect their accounts and track progress together. With paired mode, each user can share certain health and activity data with the other in real-time for mutual accountability and motivation. (See Data Sharing in Paired Mode section for details.)

Free and Paid Access

Macrofy does not offer a full free tier or a free trial. Guest Mode is available only to preview the app interface and is for demonstration purposes only (no data is saved and core features such as logging, recommendations, personalization, syncing, AI coaching, and Duo are disabled). To use the Service, users must create an account and subscribe to a paid plan. Macrofy offers two paid plans — Solo and Duo — with subscription options such as monthly and annual billing (see Section 8 for details).

Additional new features may be introduced over time. All new features that enhance or modify the current Service shall also be subject to these Terms.

4. Health and Medical Disclaimer

Macrofy is not a medical or healthcare provider, and the Service is not a substitute for professional medical advice, diagnosis, or treatment. All nutrition suggestions, exercise guidance, and health information in the app are provided for informational and educational purposes only. You acknowledge and agree that:

No Medical Advice: The Service can help you record and analyze your diet, exercise, and progress, but it does not provide medical advice or clinical services. Always seek the advice of a physician or qualified healthcare provider for any questions about your health, diet, or exercise regime. Nothing provided in the app should be construed as medical advice or used for diagnosing or treating a health problem or disease.

Consult Your Doctor: You should consult with your doctor before starting any new diet or fitness program, especially if you have any pre-existing medical conditions or concerns. If at any time you experience pain, distress, or any adverse symptoms while using Macrofy's guidance, stop immediately and consult a medical professional.

Not for Medical Use: The information and recommendations provided by Macrofy (including AI-generated coaching tips) are meant for generally healthy individuals looking to manage their nutrition and fitness. The Service is only intended for healthy adults; do not use the Service if you have a condition that could be adversely affected by changes in diet or exercise. For example, if you have diabetes, pregnancy, eating disorders, heart conditions or any other medical condition that can be impacted by diet/exercise, use the app with caution and only under appropriate medical supervision.

No Guarantee of Results: Every individual is different, and Macrofy does not guarantee any particular health, weight-loss, or fitness results or improvements from use of the app. Any success stories or examples are illustrative and not a promise that you will achieve the same outcomes. Your progress depends on many factors beyond our control.

Accuracy of Nutritional Data: Macrofy may provide nutritional information (e.g., calorie counts, macronutrient values, and nutrient breakdowns) from our own database as well as from reputable third-party data sources, including datasets such as USDA FoodData Central, Open Food Facts, and other national or regional food composition databases.

We strive to ensure the highest possible accuracy; however, nutritional data is not independently verified by us and may be incomplete, outdated, or contain errors. For example, branded product entries, user-submitted foods, or third-party database records may be inaccurate or inconsistent.

Macrofy cannot guarantee the precision, completeness, or reliability of any nutritional information provided. You should use your own judgment and, when appropriate, consult qualified professionals if you rely on this information.

Assumption of Risk: You assume full responsibility for your use of any diet plans, exercise routines, or suggestions provided by the Service. You understand that engaging in diet changes or exercise can involve risks. To the maximum extent permitted by law, we are not responsible for any personal injury, health problems, or other harm or damages that may result from your use of the Service. You agree that your use of Macrofy is at your own risk.

By using Macrofy, you acknowledge these disclaimers and agree that Macrofy is not liable for any decisions you make regarding your health as a result of information obtained through the Service.

5. AI Coaching and Recommendations (AI Disclaimer)

Macrofy includes an AI-driven virtual coaching feature. This means some advice, answers, or feedback you receive in the app is generated by artificial intelligence algorithms rather than a human. While we hope you find the AI Coach helpful and insightful, it is important to understand its limitations:

Informational Purposes Only: Any guidance or content provided by the AI Coach is for general informational purposes and does not constitute professional advice (medical or otherwise). The AI's suggestions are based on patterns and data, but may not be accurate, comprehensive, or suited to your personal circumstances. The AI is not a certified nutritionist, trainer, or doctor, and it cannot account for all the nuances of an individual's health situation.

No Guarantee of Accuracy: The AI-generated responses are provided on an "as-is" basis. We do not guarantee the accuracy, reliability, or usefulness of AI outputs. The AI might occasionally produce incorrect, outdated, or irrelevant suggestions. For example, the AI might misinterpret your input or provide an answer that is not optimal for you. You should use common sense and, when in doubt, seek advice from a qualified professional.

User Responsibility: You agree that any reliance on information provided by the AI Coach is at your own risk. Macrofy, operated by MB "Appmonster Technologies" (the "Company"), shall not be held liable for any outcomes (positive or negative) resulting from your use of or reliance on AI-generated suggestions. You are solely responsible for determining whether and how to apply any advice generated by the AI Coach. Always consider your own personal circumstances and consult a qualified professional if needed.

Emerging Technology: You understand that AI coaching is an emerging technology. The feature will improve over time, but it has inherent limitations. The AI may not understand all context or may lack empathy/judgment that a human coach would have. We appreciate user feedback as it helps us refine the AI, but in the meantime, please use the AI features with caution and do not treat its output as absolute truth or medical fact.

By continuing to use the AI coaching feature, you acknowledge these disclaimers. We will typically label AI-generated advice in the app or explain when you are interacting with the AI (as opposed to content written by humans), so you are aware.

6. User Accounts and Security

To use Macrofy, you may need to create a user account. You agree to provide truthful, accurate, and complete information when creating your account (such as a valid email, age, etc.), and to keep this information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Account Security: Do not share your account credentials with others. If you suspect any unauthorized use of your account or any other breach of security, you must notify us immediately at our contact email. We are not liable for any loss or damage arising from your failure to secure your account.

Account Usage: You agree not to create multiple accounts in a manner that violates these Terms or to impersonate any other person. If we have provided a way to log in via third-party platforms (for example, Sign in with Apple, Google, etc.), any such login remains subject to those third parties' terms as well.

Account Termination: We reserve the right to suspend or terminate your account (or your access to certain features) at any time if we reasonably believe that you have violated these Terms, are misusing the Service, or creating harm/risk to us or other users. (See also Section 12 on Termination.) You are free to stop using the Service and may delete your account at any time. Please consult our Privacy Policy for details on data deletion.

7. Data Sharing in Paired Mode

Macrofy offers a Paired Mode feature that allows two users to link their accounts for a shared experience (for example, a couple working on a fitness journey together, or a user and a coach). If you choose to activate Paired Mode, please be aware of the following terms:

Mutual Consent: Paired Mode is voluntary and requires an invitation from one user and explicit acceptance from the other. By initiating or accepting a pairing request, both users give informed consent to share certain categories of personal data with one another and confirm that they have the legal right to share such information.

When Paired Mode is active, your paired partner may be able to see certain information related to your use of the Service, including:

  • Profile information: your avatar and basic profile details.
  • Daily nutrition data: logged meals/food entries, calorie intake, macro breakdown, and water tracking.
  • Behavior and consistency indicators: whether you logged on a given day (including missed days), and the ability to browse between days where logs exist.

What is NOT shared in Paired Mode:

  • Activity and movement data: steps, workouts, active calories, and activity summaries are not shared.
  • Wellness signals and "stats": sleep, recovery, stress, and any similar wellness metrics are not shared.
  • Progress metrics (streaks, achievements, trends, goals): currently not available in Paired Mode and are not shared (these may be added later if the feature is implemented).
  • AI-generated insights: not shared under any circumstances.
  • Weight visibility (optional): Weight entries are hidden by default. If a user explicitly enables weight sharing, the paired partner may see only the most recent weight value (not full history, charts, or statistics).

Macrofy will clearly present the list of data being shared when you enable Paired Mode. You should not invite someone you do not trust, as this feature grants them ongoing visibility into portions of your health, nutrition, and activity information.

Scope of Sharing: In Paired Mode, each paired user will be able to see select information about the other (e.g., daily calorie intake, steps, achieved goals, or other progress metrics). However, sensitive data (for example, precise health measurements or personal contact info) will not be shared unless explicitly stated. We design the sharing scope carefully to balance usefulness with privacy. Make sure you review what data will be shared when you enable the mode.

Privacy and Responsibility: We take appropriate steps to protect your data (see Section 9 on data handling). However, once you choose to share information with another user through Paired Mode, we cannot control how that person will use, store, or disclose your information outside the Macrofy environment. We expect all users to respect each other's privacy and to use shared data solely for mutual support within the app.

By using Paired Mode, you acknowledge and agree that the Company is not responsible for any disclosure, misuse, or negative consequences arising from the information you voluntarily share with your paired partner.

Example: If you share your daily logs — such as your weight, calorie intake, sleep patterns, stress levels, or activity summaries — with your paired partner, and that person later screenshots, copies, forwards, discusses, or otherwise shares this information with others without your permission, this action is entirely outside of Macrofy's control. The Company cannot prevent such behavior and is not liable for the outcome, even if this conduct violates our community guidelines or general expectations of privacy.

Opt-out and Termination of Pairing: Either user can terminate the paired connection at any time through the app settings. If pairing is removed, the other user will no longer receive your data updates going forward (though they may still retain historical data that was shared during the pairing period). We reserve the right to disable or suspend a paired connection (or the entire feature) if we suspect misuse or for technical/security reasons.

Use Case Only: Paired Mode is intended for personal use between two individuals who know each other (or have a coach-client relationship) to motivate and support each other. It should not be used for any commercial, medical, or unlawful purpose. Both users in a pair are equally bound by all terms of this agreement.

By using Paired Mode, you acknowledge these terms. Ensure you also read our Privacy Policy to understand how we handle data that is shared through this feature.

Restrictions on Use of Paired Mode

Paired Mode is designed exclusively for two individuals who live together (such as partners, spouses, or cohabitants) and who use the feature for shared nutrition, activity, and wellness tracking. By enabling Paired Mode, both users confirm that:

  • They reside in the same household, meaning the same home or apartment.
  • They live in the same city or locality, allowing the feature to function as intended.
  • They are in a real-life relationship or cohabiting arrangement, and the feature is used for legitimate, personal, non-commercial purposes.

Paired Mode must not be used by unrelated individuals who do not live together, or by users attempting to misuse shared data features.

Macrofy reserves the right to disable Paired Mode or terminate both linked accounts if we reasonably believe that:

  • the two accounts do not belong to real cohabitants,
  • the feature is used fraudulently or misleadingly,
  • the pairing is created for unauthorized sharing, monitoring, or abuse,
  • the accounts violate our Terms, Privacy Policy, or data protection rules,
  • the pairing uses inconsistent device regions, API sources, or patterns suggesting misuse.

We may take such action at our discretion to protect user privacy, security, and the intended purpose of the feature.

8. Payments, Subscriptions, and Billing

Guest Mode

Macrofy lets you explore the app interface without registering by tapping "Continue as a Guest." Guest Mode is for demonstration only and is not a free version of the Service:

  • no data, progress, or history is saved;
  • all core features are disabled, including (without limitation) food logging/tracking, recommendations, personalization, syncing, AI coaching, and Duo (paired mode);
  • to use the Service (including logging data and receiving recommendations), you must create an account and subscribe to a paid plan.

Macrofy does not offer a free trial and does not offer a full free tier. Access to the Service's features is available only through paid plans.

Paid Plans and Subscriptions

Macrofy offers two paid plans:

  • Solo (individual plan);
  • Duo (a two-person plan: 1 + 1), available only if you meet the Duo eligibility requirements (see the "Duo (Paired Mode)" section/policy).

Available subscription options (for example, monthly and annual) and current pricing will be shown in the app at the time of purchase.

Early Access: "Pay What You Think It's Worth" (First Month)

For new users, Macrofy may offer a first-month Early Access promotion called "Pay What You Think It's Worth."

Solo (Early Access, Month 1): four price options:

  • $1 — Supporter
  • $3 — Backer
  • $5 — Early Adopter
  • $9.99 (~$10) — Founder

Duo (Early Access, Month 1): priced as Solo + 50% for the second person, with four options:

  • $1.50 — Supporter (Duo)
  • $4.50 — Backer (Duo)
  • $7.50 — Early Adopter (Duo)
  • $14.99 (~$15) — Founder (Duo)

Auto-Renewal: Auto-renewal is enabled by default. At the end of the first month, your subscription will automatically renew at the standard price for the selected plan unless you cancel before the renewal date:

  • Solo: $9.99/month
  • Duo: $14.99/month

Promotion Limit: This Early Access offer is available one time per account. The same account will not be eligible to receive this offer again.

Standard Pricing After Early Access

After Early Access ends (or if you do not choose Early Access), the following standard plans apply:

Monthly plans:

  • Solo: $9.99/month
  • Duo: $14.99/month (a 1 + 1 plan; Duo eligibility requirements apply)

Annual plans ("3 months free" / ~25% off):

  • Solo: $89.49/year (instead of ~$120 when paying monthly)
  • Duo: $134.49/year (instead of ~$180 when paying monthly)

Payment Platform

Purchases in the iOS version of Macrofy are processed through Apple's App Store, and purchases in the Android version are processed through Google Play (or any other platform through which you obtained the app). The platform's own payment terms and conditions apply to your transaction. Macrofy does not collect or store your payment information for in-app purchases — payment processing is handled by the platform.

Managing and Canceling Your Subscription

After purchase, you can manage or cancel your Macrofy subscription at any time through your platform account settings (for example, Apple ID Subscriptions or Google Play subscription settings).

Important: Deleting the app does not cancel your subscription — you must cancel it through the platform to stop future charges.

If you cancel, you will keep access to paid features until the end of your current billing period. After that, your access to the Service's features will end.

Refunds

Fees are generally non-refundable, except where refunds are required by the platform's policies or by applicable law. Any refund requests must be submitted through the platform where you made the purchase.

Failed Payments

If a charge is declined or cannot be processed, the platform may attempt to charge again later. If payment continues to fail, we may restrict or suspend your access to paid features until payment is successfully completed.

9. Data Privacy and Security

Your privacy is very important to us. Our practices regarding the collection, use, and disclosure of user data (including personal information and health data) are described in detail in our Privacy Policy (which is available via the app and on our website). We strongly encourage you to read the Privacy Policy. By using Macrofy, you consent to the collection and use of your data in accordance with the Privacy Policy.

Key points on data and security include:

Data Collected: Macrofy collects and processes various types of data to provide the Service, such as personal information you provide (like age, weight, goals), data you log in the app (foods, exercises), and data from integrated services (like Apple HealthKit or Google Fit if you grant permission). We may also collect device information and usage analytics to improve our services. All data we collect is used to operate and personalize the app experience (for example, to calculate calorie requirements, to set up personalized recommendations, to interpret your tracking input with AI, etc.). We do not collect data from Apple Health or similar sources unless you explicitly connect and authorize such integration.

Health App Integrations: If you choose to connect Macrofy with third-party health platforms (such as Apple HealthKit or Google Fit), you grant Macrofy permission to read and/or write specific categories of data from those platforms. We use this information solely to deliver, personalize, and improve the health and wellness features within the Service. We do not use HealthKit or Google Fit data for marketing, advertising, or data monetization, in full compliance with Apple's and Google's policies.

Examples of how we use this data include:

  • Adaptive Calorie Adjustments: Using your step count, activity minutes, heart rate, and active calories to dynamically adjust your daily calorie target.
  • Sleep and Recovery-Based Personalization: Using sleep duration or sleep quality (if available) to modify recommendations for calorie intake, meal timing, or training intensity.
  • Cycle Awareness for Women: If you choose to grant access to menstrual cycle tracking data (such as cycle phase, symptoms, or period dates), Macrofy may adjust insights or recommendations to reflect changes in energy levels, hunger patterns, metabolism, or training readiness across different phases of the cycle.
  • Wellness Trends and Long-Term Insights: Heart rate variability (HRV), resting heart rate, or stress indicators (if supported by your device) may help us fine-tune recommendations around activity, nutrition, or recovery.
  • Progress Tracking: Accessing weight entries, body measurements, or activity summaries to update your goals and visualize trends.
  • Motivational Feedback and AI Assistance: Using aggregated data (such as whether you reached your movement target) to trigger AI-generated reminders, encouragement, or daily summaries.

We will not share, sell, or transfer any HealthKit- or Google Fit-derived data to third parties without your explicit consent.

Note: Apple HealthKit and Google Fit are governed by Apple's and Google's own terms and privacy policies; please review those when connecting your health data.

Third-Party Service Providers: Macrofy uses reputable third-party service providers to operate, support, and improve various components of the Service. These providers process data on our behalf under strict confidentiality obligations and in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR).

Examples of the types of third-party services we use include:

  • Cloud Hosting & Infrastructure: Our backend servers and databases are hosted by Hetzner Online GmbH (EU-based hosting provider). We also use Supabase (self-hosted on Hetzner) and Appwrite to manage data storage, authentication, and backend operations.
  • Notifications: We may use Firebase Cloud Messaging (FCM) solely for the purpose of delivering push notifications. FCM is not used for analytics, advertising, or data monetization.
  • Subscription Management: We use RevenueCat to securely process and validate in-app purchases and subscription statuses across iOS and Android. RevenueCat does not receive or process your health data.
  • Artificial Intelligence Services: For generating AI-based insights, coaching responses, or transcription features, we may use third-party AI providers such as OpenAI, Anthropic, Fireworks, or self-hosted AI models running on our own servers (e.g., Whisper for audio transcription). These services process only the information needed to generate the requested output and are contractually restricted from using your data to train models.
  • Platform Providers: Apple and Google may process data relating to app distribution, account authentication, payments, or device integrations (e.g., Apple HealthKit, Google Fit). These platforms operate under their own terms and privacy policies.

All third-party providers are selected based on their ability to maintain high standards of security, reliability, and GDPR compliance. We do not sell your data or share your health-related data with third parties for marketing or advertising purposes.

Data Security Measures: We implement appropriate technical and organizational measures to safeguard your personal data. These measures include, but are not limited to: secure data transmission (e.g., HTTPS/TLS), encryption of sensitive data at rest and in transit, access controls and role-based permissions for authorized personnel, routine security monitoring, and server infrastructure hosted in secure data centers located in the European Union. We follow industry-standard security practices designed to protect your information against unauthorized access, alteration, disclosure, or destruction. However, no method of electronic storage or transmission is fully secure, and therefore we cannot guarantee absolute security of your data. You also play an important role in protecting your information by keeping your account credentials confidential, using strong passwords, and securing access to your devices.

GDPR and Data Rights: If you are a resident of the European Economic Area (EEA), the United Kingdom, Switzerland, or any other region with applicable data protection laws, you may have specific rights regarding your personal data. These may include the right to access, correct, update, or delete your data; the right to restrict or object to certain types of processing; the right to data portability; and, in some cases, the right not to be subject to automated decision-making.

Privacy Policy: These Terms incorporate our Privacy Policy by reference. If there is a conflict between these Terms and the Privacy Policy with respect to personal data handling, the Privacy Policy will govern that aspect.

By using the Service, you acknowledge that you have read and understood the Privacy Policy and agree to how Macrofy handles your data. If you do not agree, please discontinue use of the app.

10. Third-Party Services and Content

Macrofy integrates with or relies on certain third-party services and content to function effectively. This includes, but is not limited to:

OpenAI: The AI Coach feature in Macrofy may send your questions or input to OpenAI's API (or a similar AI service) in order to generate responses. By using the AI Coach, you understand that your input (which may include personal data or health-related information you provide in a question) will be transmitted to and processed by this third-party AI provider. We do not include information that directly identifies you (like your name or contact info) in these requests, but the content of your query could potentially include personal details that you volunteer. OpenAI (or the AI provider) will process the data to return a helpful answer, but it does not use your data for any purpose beyond providing us the response (as per OpenAI's usage policies). We do not guarantee the availability or infallibility of any third-party AI service. We are not responsible for any action or output generated by the third-party AI, beyond our control. If the AI produces inappropriate or incorrect content, please let us know so we can correct it, but understand that the third-party service's terms (OpenAI's terms of service and privacy policy) also apply to your use of the AI features.

Analytics and Crash Reporting: We may use third-party analytics tools (such as Google Analytics for Firebase or similar) to collect anonymized information about how users interact with our app, so we can improve the user experience. We may also use services that collect crash reports or error logs if the app malfunctions. These services might automatically collect certain information about your device or app state at the time of a crash (for example, device model, OS version, and some user actions leading up to the crash). This information is used solely to diagnose and fix issues.

External Links and Content: The Service or communications you receive from Macrofy might contain links to third-party websites or content (for example, a blog article about nutrition, or a partner's service). These are provided for convenience or reference only. We do not endorse and are not responsible for third-party content or websites, and your use of them is at your own risk. Once you click a third-party link, you will be subject to that third party's terms and policies. Macrofy has no control over and does not warrant or make any representations regarding any third-party materials or services.

Third-Party Devices/Apps: If you connect a third-party device or app to Macrofy (such as a smart scale, wearable fitness tracker, or another fitness app via an API integration), any data obtained from that device/app is covered by these Terms once in our system, but we are not liable for the accuracy or availability of data from the third-party source. For example, if a connected smart scale provides an incorrect weight reading, Macrofy is not responsible for that error. Similarly, any issues arising from the use of third-party devices (like injury or device malfunction) are outside the scope of our Service and responsibility.

In summary, while Macrofy works with third-party services to enhance your experience, those services are separate entities. We do not assume liability for the actions, content, or data policies of any third parties. However, if you encounter a problem with an integrated service, we welcome you to report it to us, and we will do our best to assist or mitigate the issue from our side.

11. Intellectual Property and License

All rights, title, and interest in and to the Macrofy Service (including the app, website, and all content, features, and software within) are owned by or licensed to MB "Appmonster Technologies" and are protected by intellectual property laws. This includes our trademarks, logos, brand elements, as well as the collective content in the app such as text, graphics, user interface design, databases, and software code.

License to You: Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, non-sublicensable, revocable license to download, install, and use a copy of the Macrofy mobile application on your personal device(s) solely for your own personal, non-commercial use. This license is for use of the Service, and does not grant you any ownership of our intellectual property. You agree not to use our Intellectual Property (such as content or code) for any other purpose without our prior written permission.

Restrictions: You shall not, and shall not allow any third party to, do the following: (a) copy, modify, or create derivative works of the app or any content within it; (b) reverse engineer, decompile, or attempt to extract the source code of the software (except to the extent such restriction is prohibited by applicable law); (c) remove or obscure any copyright, trademark, or other proprietary notices on the app or within the content; (d) use any robot, spider, scraper, or other automated means to access the Service for any purpose without our express written permission; (e) use the Service in a manner that violates any laws or regulations or infringes any rights of any other person or entity.

User-Generated Content: To the extent that our app allows you to input or create content (for example, adding a custom food, recipe, photo, or posting on a forum or community feature if available), you retain ownership of the content you create. However, by submitting any content through Macrofy, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and (if needed) adapt such content solely for the purpose of operating and improving the Service. We will never sell your personal logs or private data. This license ends when you delete the content or your account, except to the extent that the content has been shared with others and they have not deleted it. You represent that you have the necessary rights to any content you submit and that it doesn't violate the rights of any third party.

Feedback: If you provide us with feedback, suggestions, or ideas about Macrofy ("Feedback"), you agree that we can use this Feedback without restriction or compensation to you, and you irrevocably assign to us all right, title, and interest in that Feedback.

All rights not expressly granted to you in these Terms are reserved by the Company and its licensors. Unauthorized use of any of our intellectual property or the Service may result in termination of the limited license and may violate copyright, trademark, or other laws. If you breach these restrictions, you may be subject to prosecution and damages.

12. Termination of Use

Termination by You: You may stop using the Macrofy app at any time. If you wish to delete your account, you can do so by following the instructions within the app (if available) or by contacting customer support. Deleting your account will deactivate your access to the Service and remove or anonymize personal data in accordance with our Privacy Policy (note that some data, like aggregate usage stats, may survive in an anonymized form). If you are a subscriber and you delete your account without canceling your subscription, please be aware that deletion of the account does not automatically cancel subscription payments — be sure to cancel the subscription separately to stop billing (see Section 8 on Managing Subscription).

Termination or Suspension by Us: We reserve the right to suspend or terminate your access to the Service (or certain features of the Service) at any time, with or without notice, if we reasonably believe: (a) you have violated any provision of these Terms or any applicable law; (b) you infringe or misappropriate our intellectual property or that of others; (c) you engage in fraudulent, abusive, or harmful behavior (for example, attempting to hack the app, harassing other users, or using the Service in a way that could cause liability to others or us); or (d) we need to do so to protect the security and integrity of the Service or our users, or in response to requests by law enforcement or other government agencies. We will try to give you prior notice of such action where practicable, but we are not obligated to do so.

In the event of termination by us for a violation of terms or misconduct, you are not entitled to any refunds for any subscriptions or purchases you have made (to the maximum extent permitted by law).

Effect of Termination: Upon any termination of these Terms (whether by you or us), your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination (such as intellectual property rights, disclaimers of warranties, indemnities, limitation of liability, and governing law) will continue to apply even after termination.

13. Disclaimers of Warranties

Use at Your Own Risk: The Macrofy Service is provided on an "AS IS" and "AS AVAILABLE" basis. Your use of the Service is at your sole risk. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, with respect to the Service and content. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties that might arise from course of dealing or course of performance.

In particular, we make no guarantees that: (a) the Service will meet your specific requirements or expectations; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) the information or results that may be obtained from the use of the Service will be accurate or reliable; or (d) any defects or errors in the app will be corrected. While we strive for accuracy and reliability, we do not warrant the completeness or reliability of any information provided via the app (including data from third parties or AI-generated content).

No advice or information, whether oral or written, obtained by you from us or through the Service shall create any warranty not expressly stated in these Terms. Macrofy does not endorse any specific diets, workouts, or other activities recommended in the app; these are provided for general informational use.

14. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MB "Appmonster Technologies" (Macrofy), its officers, employees, agents, partners, or licensors be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, revenue, goodwill, data, or other intangible losses, arising out of or related to your use of (or inability to use) the Service. This limitation applies whether such claims are based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages, and even if a remedy set forth herein is found to have failed its essential purpose.

Additionally, to the extent permitted by law, our total cumulative liability to you for any direct damages arising from or related to the Service (for any cause of action and under any theory of liability) is limited to the amount you paid to us for the Service in the 12 months immediately preceding the event giving rise to the claim (or, if you have not paid us for the use of any Service, the amount of €0). For example, if you have paid $50 in subscription fees in the last year, that is the maximum we would potentially be liable for direct damages.

In jurisdictions that do not allow the exclusion or limitation of certain types of damages, some of the limitations stated above may not apply to you to the extent prohibited by applicable law. In such situations, our liability will be limited to the maximum extent permitted under the relevant legal framework.

Additional Notice for Users in the European Union: Nothing in these Terms shall exclude or limit our liability where such exclusion or limitation is not permitted by EU or local consumer protection laws. This includes liability for gross negligence, intentional misconduct, fraud, or for death or personal injury caused by our negligence or willful actions. These rights cannot be waived by contract.

However, by using the Service, you acknowledge and agree that Macrofy is a wellness and lifestyle application that provides self-guided content, not medical or professional services, and therefore our potential legal liability to you is inherently limited. To the fullest extent allowed by law, any liability we may have will remain narrow in scope and proportionate to the nature of the Service.

You agree that the limitations of liability and disclaimers in these Terms are a fair allocation of risk and an essential part of the bargain between you and us, and that without these limitations, we would not be able to provide the Service to you at the current prices (or at all).

15. Indemnification

You agree to indemnify, defend, and hold harmless MB "Appmonster Technologies" (Macrofy) and its officers, directors, employees, agents, and affiliates, from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees and costs) that arise from or relate to: (a) your use or misuse of the Service, (b) your violation of these Terms, (c) your violation of any law or regulation or the rights of any third party, or (d) content that you submit or transmit through the Service (for example, if you share data that infringes someone's rights or is unlawful). We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claim. You agree not to settle any such matter without our prior written consent.

This indemnification obligation will survive any termination of your account or of the Service.

16. Changes to the Terms

We may modify or update these Terms of Service from time to time. If we make material changes, we will notify you by posting the updated Terms within the app or on our website and updating the "Last Updated" date at the top, and/or by sending you a notification or email if appropriate. The latest version will always be available for you to review.

Continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to any updated Terms, you should stop using the Service and cancel any subscriptions. We encourage you to periodically review the Terms to stay informed of any updates.

17. Governing Law and Dispute Resolution

These Terms and your use of the Service are governed by and construed in accordance with the laws of Lithuania, without regard to its conflict of law principles. However, if you are a consumer resident in the European Union, other mandatory consumer protection provisions may apply under the laws of your country of residence, which will not be overridden by this governing law clause.

Jurisdiction: You agree that any dispute or claim arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Lithuania, unless otherwise required by applicable consumer protection laws. We both agree to the personal jurisdiction of such courts.

As a consumer, you may also have the right to pursue a dispute in your local courts or through alternative dispute resolution (such as mediation) under applicable local law. These Terms do not limit any such rights you have that cannot be waived by contract.

18. Miscellaneous

Entire Agreement: These Terms (along with the Privacy Policy and any additional guidelines or policies we provide) constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings (whether oral or written) relating to the Service.

No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision must be in writing and signed by us to be effective.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason by a court of competent jurisdiction, that provision shall be eliminated or limited to the minimum extent such that the remainder of the Terms will continue in full force and effect.

Assignment: You may not assign or transfer your rights or obligations under these Terms to any other party without our prior written consent. We may assign or transfer our rights and obligations to an affiliate or in connection with a merger, acquisition, sale of assets, or by operation of law. These Terms shall bind and inure to the benefit of the parties, their successors, and permitted assigns.

Third-Party Beneficiaries: Except as explicitly provided in these Terms, there are no third-party beneficiaries to this agreement. Your agreements and obligations hereunder are for the benefit of you and MB "Appmonster Technologies" (Macrofy) only.

Headings: Section titles or headings in these Terms are for convenience only and have no legal or contractual effect.

Language: These Terms may be provided in multiple languages. The English version of these Terms shall prevail in case of any inconsistency or interpretation disputes (to the extent permitted by law).
